Special Provisions

Back2GAC II Raffle

  • The provisions in this section apply specifically and exclusively to the Back2GAC II Raffle which will be conducted during the Event on 25/09/2021
  • Entry is based on submitting a valid Expression-of-Interest during/at the Event, with the Contest Prize consisting of:
    • 10x Personal Training Sessions (30 mins) for Members; or
    • 5x Personal Training Sessions (30 mins) for Non-Members
  • Non-Members who sign-up on or before 01/10/2021 will correspondingly qualify for the Member Contest Prize
  • Only one entry is to be submitted per eligible person, with duplicates considered to be grounds for disqualification
  • The winner will be selected by way of a random draw conducted on 08/10/2021 at Wanangkura Stadium 24-7
  • The winner will be notified via the mobile/email details provided within three (3) days of the draw

The provisions contained herein were published on 22/09/2021 and will not be changed, modified or otherwise altered during the contest period. Entering and participating signifies acceptance of all the General Provisions outlined in the section below, as well as the contest specific provisions specified herein.

General Provisions

The provisions in this section apply to any online game/contest run by the Town of Port Hedland (ABN 19 220 085 226), operating as Port Hedland Leisure which is categorised as a 'Game of Chance' by the Gaming and Wagering Commission Act 1987.

Eligibility

Open to all current residents of Australia, excluding NSW, aged 18 years or over.

Exclusions

Current employees of the Town of Port Hedland and their family members are prohibited from participation.

Nominations

The specific criteria, means and methods utilised for determining winners will be specified in original and derivative advertisements.

Entries commence at the time of original advertisement and close at 5:30pm AWST on the closing day specified in original and derivative advertisements.

Award

All prizes will be specified in original and derivative advertisements. Prizes cannot be transferred or redeemed for cash/alternative goods.

Representations

All images are for illustration purposes only. Actual products may vary.

Unless otherwise specified, featured prizes are not an endorsement of products/services. Furthermore, the inclusion of the specified prizes does not imply that the owners/producers of the products/services necessarily endorse the associated contest, or have provided explicit permission for their inclusion, or that there is any relationship between the Town of Port Hedland and the owners/producers.

Selection

Unless otherwise specified: winners will be selected and resulting witnessed by a panel from the Town of Port Hedland which consists of at least three (3) people.

Notification

Winners will be publicly notified on Facebook within a week from the end of the game/contest. If winners fail to respond to the notification, or claim their prize within thirty (30) days of notification, a redraw will be conducted.

Collection

Prizes should be collected during normal business hours from Wanangkura Stadium 24/7, which is located at 1 Hamilton Road, South Hedland. Prizes can be posted if located more than 30km from the South Hedland Town Centre; however winners will be responsible for all costs associated with collecting/posting and using prizes.

Indemnification

By entering and participating, entrant agrees to hold harmless, defend and indemnify the Town of Port Hedland from and against any and all claims, demands, liability, damages or causes of action (however named or described), losses, costs or expenses, with respect to or arising out of or related to (i) entrant’s participation in the Sweepstake, or (ii) entrant’s participation in any Prize related activities, acceptance of a Prize and/or use or misuse of a Prize (including, without limitation, any property loss, damage, personal injury or death caused to any person(s).

Third Parties

By entering and participating, entrant agrees to hold harmless, defend and indemnify Facebook from and against any and all claims, demands, liability, damages or causes of action (however named or described), losses, costs or expenses, with respect to or arising out of or related to (i) entrant’s participation in the Sweepstake, or (ii) entrant’s participation in any Prize related activities, acceptance of a Prize and/or use or misuse of a Prize (including, without limitation, any property loss, damage, personal injury or death caused to any person(s). This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook.

Publicity

Winners grant the Town of Port Hedland permission to publicly reference his/her name and Facebook profile for publicity purposes without payment of additional consideration, except where prohibited by law.

Records

Records relating to all online games/contests will be maintained for a period not less than twelve (12) months from entry close and shall be made available to authorised officers upon request.

Variations

In the event of any conflicting provisions: advertised terms and conditions take precedence over the standard provisions contained herein.

Acceptance

The provisions contained herein were last updated on 05/07/2019 and will not be changed, modified or otherwise altered while any game/contest is ongoing. Entering and participating signifies acceptance of all of the terms and conditions specified within this section.
